Last week, three Muslim men were held in Uttar Pradesh under the new anti-conversion law for stalking and sexually harassing a 22-year-old married woman, and also forcing her to convert and marry one of them. However, Bareilly police has now confirmed that the charges made against all the men by the complainant woman were fake and the suspects were ‘incorrectly framed’.
One out of the three falsely accused men was in a relationship with the woman, who is a nursing college student in Bareilly. As reported by TOI, the woman was in a relationship with the accused man for over a year and had also eloped by choice with him last September. The accused man works as a driver.
Later, her uncle approached the local police and filed a missing complaint with them. The woman was reportedly traced and recovered after nine days and soon after that, she was married off to another man from her community by her family last month.
However, the woman accused her former friend cum lover of stopping her at gunpoint, asking her to convert and re-marry him. She said she was stalked by the main suspect even after she got married. She also accused his other two accused friends of joining him and threatening to kill the members of her family. The woman also exclaimed that she could kill herself too.
Police Charges & Investigation
Based on woman’s complaint, the police filed an FIR on Friday night and a case was registered at Faridpur police station under:
- Sections 354 (attempt to outrage the modesty of a woman)
- Sections 506 (criminal intimidation) of IPC
- Sections 3/5 of the UP Prohibition if Unlawful Conversion of Religion Ordinance, 2020
Shockingly, the charges levied by the woman turned out to be false and the accused were released on Saturday.
The police stated that the woman complainant spoke of a specific incident that happened on December 1 and filed serious allegations against all three men – who were in their mid 20s and related to each other. The police however, revealed that after investigating the details of the woman’s accusations, none of the three alleged accused were present in Bareilly on that day. The police called out the fake charges levelled by the woman complainant.
Bareilly SSP Rohit Singh Sajwan said that the probe was completed and all three Men were wrongly framed. The SSP further indicated that a report under IPC section 182 (false information with the intent to cause a public servant to use his lawful power to the injury of another person) will be submitted against the complainant.
Faridpur SHO Surinder Pachauri added,
After checking the mobile surveillance report, it was evident that the men were not in the village on the day of the incident mentioned in the FIR. We have not found any evidence against them.
The SHO further said,
On the other hand, the facts mentioned in the woman’s statement were found incorrect and she even said that she doesn’t use a mobile phone. We are now trying to find out if she had registered the complaint under someone’s direction.
One of the family members of the suspects’ expressed their relief after the false charges had been dropped against the Men in their family and quoted:
Our children were being framed in this case. We request police to ensure an impartial probe.
